Welcome to Snakt! Snakt, Inc., 625 Broadway, New York, NY 10012 ("Snakt," "we," "our," or "us") provides a service that allows its users to upload, create, combine, alter, and share videos through its website located at www.snakt.com and its mobile application (the "Service").

This Privacy Policy ("Privacy Policy") describes how and when Snakt collects, uses, and shares your information when you use the Service. This Privacy Policy applies to the information and Content you provide to us through the Service. By accessing or using the Service or any Content uploaded, downloaded or appearing on the Service, you are consenting to the collection, transfer, manipulation, storage, disclosure, and other uses of your information that are described in this Privacy Policy. Regardless of which country you reside in or supply information from, you authorize Snakt to use your information in the United States and any other country where Snakt operates. Capitalized terms used but not defined herein will have the meanings ascribed to them in the Terms of Service.

1. Information Collection and Use

We collect "Personal Information" and "Non-Personal Information" from you in order to provide and improve the Service. Personal Information is information that can be used to identify you, including your name and your email address. Non-Personal Information is information that cannot be used to identify you, including time, date, and geolocation information of a video you post through the Service, anonymous usage data, demographic information, preferences that you submit, and preferences that are generated based on the data you submit. We will not share your Personal Information with others except as provided in this Privacy Policy.

A. Creating a Snakt Account and Profile Information

To sign up for the Service, you may need to provide us with your first and last name, username, date of birth, an email address or phone number, and a password. You may have the option, but are not required, to provide us with additional information, including a short bio, location, and profile picture.

You may review, update, or modify your profile information and contact information at any time. Profile information is available publicly on the Service, such as on your profile page.

B. Contact Information

We may use your name, email address, or phone number to send you messages, including information about the Service, respond to your requests, and facilitate your use of the Service. If you do not want to receive any promotional emails from Snakt, you may follow the unsubscribe instructions in any promotional email. Please note, though, that we will still be able to send you administrative emails, such as updates to our Privacy Policy.

C. Content, Following, and other Public Information

As part of the Service, you will be allowed to upload, display or otherwise make available ("post") videos, photos, information, text, graphics, audio recordings, or other materials through the Service. We refer to this collectively as "Content." The Service is a video sharing platform, and we allow and encourage using Content shared by others. Accordingly, any Content you provide is made public to other users of the Service. In addition, you may choose to make your profile information or other activity public to other users of the Service. This includes information such as the accounts you follow, the Content that you like, and any other public interactions on the Service. Your public information may be broadly and instantly disseminated. For instance, your profile information and any Content you choose to make public may be immediately delivered to many other users and other services that access Snakt, and those other users may in turn export or otherwise disseminate part or all of your public Content through services or media outside the Services. Snakt has no control over these outside services and when Content is shared on these outside services, the Terms of Service located at www.snakt.com/terms/ ("Terms") and this Privacy Policy do not apply. Accordingly, when you share information or Content via the Service, you should think carefully about what you are making public. We advise you not to make any contact information, including phone number, email address, street address, or instant messenger or social media address(es) or username(s) public that you do not wish to share. We are not responsible for Personal Information you choose to make public.

In posting Content to the Service, you agree not to provide Personal Information or confidential information of others unless: (i) you have obtained any required permission to do so under applicable law and, and (ii) for Personal Information relating to others, you have informed that person that their Personal Information will be subject to this Privacy Policy and you have obtained their consent to this Privacy Policy. You must do this even if an inability to obtain permission means that you cannot submit your Content or other information. By providing information to us, you are representing that you have made all the required disclosures and obtained all the necessary permissions.

D. Changing the Visibility of or Withdrawing Content

You may make your Content publicly visible on the Service at any time. However, if you later wish to change the visibility settings of any Content posted in a private group to make such Content less accessible to other users, or to withdraw any other Content previously made publicly visible on the Service, you may only do so subject to this Privacy Policy and the Terms.

Within the first 24 hours after Content is first made publicly visible, or if no other users of the Services have reused the Content (either in its original or in altered form), you may withdraw the Content from the Service by viewing the specific Content, tapping the ‘more’ button (indicated by an ellipsis [“…”]) and deleting both the ‘stack’ and the ‘bites.’ However, if it has been more than 24 hours since you first made the Content publicly available, and if other users of the Services have reused the Content (either in its original or in altered form), you may submit a written request to help@snakt.com to withdraw your Content from the Service, including the reason for withdrawing the Content. Snakt has sole discretion to determine whether or not it will withdraw the Content from the Service, provided that Snakt is not obligated to withdraw Content that was already made available to third parties, including other users, before the request was made. In addition, you understand that when you make any Content publicly available on the Service, that Content can be distributed to third-party providers or sites, so even if we approve your request on the Service, copies of your Content may continue to exist on third-party sites. Copies of your Content might also exist on search engines, archive pages, or in other instances beyond our control. Snakt shall not be liable or responsible for any distribution or dissemination of your Content outside the Service.

You may deactivate your account and discontinue your use of the Service at any time contacting us at help@snakt.com. If you wish to withdraw your Content from the Service after you deactivate your account, you may request to withdraw your Content from the Service in accordance with the procedures set forth above.

E. Log Data

When you use the Service, our servers or third-party servers under our control may collect information automatically and store it in log files ("Log Data"). Log Data may include information such as your internet protocol (IP) address, browser type, operating system, the referring web page, pages visited or actions taken, location, your mobile carrier, device, and application IDs, search terms, cookie information, and other information about our visitors. We collect this Log Data whenever you interact with the Service, for example, when you visit our websites, sign into the Service, use the Service, view or reuse videos hosted by Snakt, or interact with our email notifications. Snakt uses Log Data to provide our Services and to help us better understand user behavior in order to customize and improve the Service.

F. Do Not Track

Snakt does not collect personally identifiable information from you to track you over time and across third party websites. As a result, Snakt does not specifically respond to web browser Do Not Track (“DNT”) signals.

G. Third-Party Service Providers

Snakt uses a variety of third-party services to help us provide the Service, such as hosting the Service. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address. We also use analytics services, such as Mixpanel, to track usage data and help us understand the use of the Service. Mixpanel uses cookies, web beacons, and other commonly-used information-gathering tools to help us analyze how Users use the Service. The information generated by the tools about your use of the Service (including your IP address) will be transmitted to and stored by Mixpanel on servers in the United States. Mixpanel will use this information for the purpose of evaluating your use of the Service, compiling reports on website activity for us and providing other services relating to website activity and internet usage. Mixpanel may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Mixpanel’s behalf. By using this Service, you consent to the processing of data about you by Mixpanel in the manner and for the purposes set out above. 2. Information Sharing and Disclosure

A. Your Consent

We may share or disclose your information at your direction, such as when you choose to publicly post a video or update your profile information. We are not responsible for the Personal Information or other information you choose to publicly submit.

B. Service Providers

We may employ service providers to perform functions and provide services to us in the United States and abroad. We may share your Personal Information with these service providers only to perform these tasks on our behalf and pursuant to our instructions, and such service providers will be subject to obligations regarding your Personal Information consistent with this Privacy Policy.

C. Law and Harm

We reserve the right to preserve or disclose your account or Personal Information if we believe that it is reasonably necessary to comply with a law, regulation, or legal request; to protect the safety of any person; to address fraud, security or technical issues; or to protect Snakt's rights or property.

D. Business Transfers

If we are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets, your information may be sold or transferred as part of that transaction. You acknowledge that such transfers may occur, and that any acquirer of Snakt or its assets may continue to use your personal information as set forth in this Privacy Policy. If any acquirer of Snakt or its assets will use your personal information contrary to this Privacy Policy, you will receive prior notice.

E. Non-Private or Non-Personal Information

We may share or disclose your non-private, aggregated or otherwise Non-Personal Information, such as your public user profile information, posts on the Services, the people you follow or that follow you, the groups you belong to, or the number of users who clicked on a particular link.

3. Security

Snakt takes protecting your information very seriously. We implement reasonable security measures designed to protect your information from unauthorized access. We protect your information from potential security breaches by implementing certain physical, technological and administrative security measures. Although we strive to minimize the risk of a security breach of our system, we cannot guarantee the absolute security of your Personal Information. By using our Service, you acknowledge that you understand and agree to assume these risks. In addition, there are steps you can take to maintain the security of your account. Your account is protected by your account password and we urge you to take steps to keep your account safe by not disclosing your password and by logging out of your account after each use. In addition, because your emails to us are not necessarily secure against interception, do not include sensitive information in them.

4. International Transfer

The information we collect from you via the Service may be stored, processed and used in the United States or in any other country in which we, or any of our third-party service providers, maintain facilities. Snakt or our third-party service providers may transfer information that we collect about you, including any Personal Information, across borders and to another state, province, country or other governmental jurisdiction where the privacy and data protection laws may not be as protective as those in your jurisdiction. By registering for and using the Service, you consent to such transfer of information.

5. Links to Other Websites

The Service may contain links to third-party websites or resources. We have no control over linked websites or the content, products or services available on these websites. You acknowledge and agree that we are not responsible or liable for: (i) the availability or accuracy of such websites or resources; or (ii) the content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by the Snakt Entities of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources. Please remember that the other websites are governed by their own policies. We recommend that you review the terms and policies of those websites, including their privacy and data gathering practices. Snakt shall have no liability or responsibility for the privacy practices of any third-party website.

6. Children

Our Services are not directed to persons under 13. We do not knowingly collect Personal Information from children under 13. If we become aware that a child under 13 has provided us with Personal Information, notwithstanding anything to the contrary in the Terms or this Privacy Policy, we will delete such information and terminate the child's account and any Content posted through that account.

7. Modification

We may modify this Privacy at any time, and will update the most current version at www.snakt.com/privacy. If we determine that we have made a material change, we will notify you by sending you an email to the email address you provided when registering for your account or by posting a notice through the Service. If you continue to access or use the Service after those revisions become effective, you agree to be bound by the revised Privacy Policy.
